Forwarder's liability

Forwarder's civil liability refers to the forwarder's responsibility towards the client and third parties for any damage resulting from the non-performance or improper performance of the forwarding contract, as stipulated by the Civil Code.

Main principles of Cargo insurance

Cargo insurance encompasses activities conducted by both the sender and recipient, including third parties involved in the transportation process.

Here are the key distinctions between Cargo insurance, forwarder's liability insurance, and carrier's liability insurance:

  • Forwarder's Liability Insurance: This type of insurance limits liability to the selection of an appropriate contractor responsible for transporting the goods. It focuses on the forwarder's role in the transportation process.
  • Carrier's Third Party Liability Insurance: Liability under this insurance is limited to the proper execution of the transport order by the carrier. It specifically covers the carrier's responsibilities during transportation.
  • Cargo Insurance: Cargo insurance provides coverage for damage, partial shortages, and losses that occur during transport. It encompasses various liabilities, including carrier's liability, Rohlig SUUS Logistics' liability, inability to identify the perpetrator, and force majeure events. Unlike other insurances, Cargo insurance does not require identifying the perpetrator of the damage but rather establishing a connection between the damage and the transport process.

Attention

If the value of the shipment exceeds the maximum liability amount of the carrier or forwarder, opting for cargo insurance is advisable. We recommend purchasing Cargo insurance for all shipments valued at over PLN 5,000.

Scope of protection - advantages of Cargo insurance

Cargo insurance extends the scope of cargo protection beyond that provided by forwarder's liability insurance and carrier's liability insurance in several ways:

  • Ignoring weight limits set by various conventions and regulations (Polish General Freight Forwarding Rules, CMR Convention, Montreal Convention, Hague-Visby Rules).
  • Coverage for damage caused by extraordinary weather conditions and forces of nature.
  • Extension to include loading and unloading activities.
  • Protection against damage caused by acts of terrorism, strikes, and public riots.
  • Coverage for costs incurred in the event of a general average.

Exclusions from protection include:

  1. damage caused by the customer's willful misconduct
  2. insufficient or improper packaging
  3. hidden defects or natural properties of the goods
  4. contractual penalties and pure financial losses due to delays.
